Collaborative Law

Collaborative law is a process which offers separating couples an alternative to litigation. Instead of relying on the Court to determine what is fair, collaborative law offers the couple themselves the opportunity to agree on what is right for their children and financially for themselves in collaboration with each other and their own solicitors in a series of four-way meetings.

What is collaborative law?

It has long been recognised that litigation is a last resort because of the uncertain outcome, and the hostility that it can provoke.

In many cases it is this hostility that has the most damaging effect both on couples when trying to recover from their separation and look to the future, and on their children, who need their parents to have a working relationship in the future.

For some, it is possible to sort everything out around the kitchen table. For others who would feel vulnerable in mediation, yet would like to work towards a mutually acceptable agreement, collaborative law may be a viable alternative. It is an exciting and promising process that originated in America in 1982 and is fast taking English family law by storm. There are now growing numbers of Collaboratively trained lawyers working in England.

The collaborative law process

If you and your partner enter into the collaborative law process you will be asked to sign a participation agreement setting out the principles you both agree to follow during the process. This includes an agreement that you will:

  • Be mutually respectful of each other
  • Put your children’s interest first, and then the wellbeing of each other
  • Not go to Court to resolve your differences
  • Try creatively and constructively to find a fair solution to all issues without Court intervention (although you may ask the Court to confirm agreed arrangements)
  • Be open and transparent in the information you give each other

If you and your partner can commit to this then Collaborative Law may well work for you. For more information get in touch with the Family team by calling 0330 0945 500 or complete the form below and we'll get back to you.

Dear Beth, I just wanted to take a moment to sincerely thank you for all the support, advice, and hard work you've provided throughout my case. It’s been a challenging and emotionally charged process at times, but your clarity, professionalism, and steady guidance have made a real difference. I’ve felt reassured knowing you were in my corner, and I’m genuinely grateful for the time and effort you’ve put in on my behalf. You haven’t just helped me navigate the legal process — you’ve helped me protect what matters to me the most, my daughter. That’s something I’ll never forget. With heartfelt thanks, Ashley

We used Neves to purchase our first house. Our main communication was with Jackie who was helpful and responsive. We were impressed with the service overall although we did have a few occasions with slow replies/updates. Once we were close to the end of the process the service was very good and very prompt action was taken. As first time buyers, we would’ve benefited from a bit more explanation, however we would still recommend Neves and we would use them again.

I cannot speak highly enough of their service and support during a difficult time. Emma and Lynda were in consistent communication and gave me a lot of confidence. Their empathy and understanding was greatly appreciated and the advice Emily offered was amazing. Highly recommended

I can’t thank Beth at Neves Solicitors enough for the incredible support and representation she provided during my family court case. Her professionalism, compassion, and expertise made all the difference during what was a very stressful and emotional time. From our first meeting, Beth was understanding, honest, and reassuring. She always kept me fully informed and explained everything in a way that was clear and easy to understand. Her calm and confident approach, especially in court, gave me a sense of security that I truly needed. Thanks to Beth’s hard work and dedication, we achieved a fantastic outcome — far better than I had hoped for. I’m so grateful to her and the team at Neves, and I wouldn’t hesitate to recommend Beth to anyone needing support with family law. She’s absolutely outstanding.

I would like to mention my very satisfying experience with Emily Pope of Neves (Luton office). Emily dealt efficiently with my divorce taking careful instructions and guiding me around the pitfalls. Emily was always prompt in communicating and pleasant in dealing with me. I always knew I was in good hands. Neves' charges were extremely reasonable. This overall good experience reinforced the positive impression made by the firm in dealing with the making of my new will which was not straightforward. I gladly recommend Emily and Neves for any matters in which they profess to have expertise.
